Licence agreement (EULA)

No. 01

The agreement

This licence agreement is between you and me, Michal Nešťák, sole trader, Beniakova 3086/3, 841 05 Bratislava-Karlova Ves, Slovakia, IČO 57035041. It is not with Apple and not with Paddle. I alone am responsible for SealedVoice and its content.

You accept this agreement by installing or using SealedVoice.

No. 02

Your licence

I grant you a non-exclusive, non-transferable licence to use SealedVoice. One licence lets one person use it on all the Apple-branded Macs they own or control. You pay once.

A pack is several licences (seats), bought by one buyer, for example a law firm. The buyer assigns each seat to one named person and may move a seat to another person when the first stops using SealedVoice.

A copy from the Mac App Store may be used as permitted by the Usage Rules in Apple’s Media Services Terms, including by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts.

No. 03

Free trial

You may use SealedVoice free of charge for the trial amount stated on this site. After that, you need a licence to keep using it. Do not reset the trial or work around it.

No. 04

What you may not do

You may not sell, rent or publish a licence key, or share it with anyone other than the person its seat is assigned to. You may not distribute the app, or reverse engineer, decompile or disassemble it, except where the law allows.

For copies from the Mac App Store, the Usage Rules in Apple’s Media Services Terms and, for volume purchases, Apple’s Volume Content Terms prevail where this agreement conflicts with them.

No. 05

Updates

Updates are free for the period stated at the time of purchase, or for copies from the Mac App Store, as the App Store provides them. I’m not obliged to release updates.

Before version 1.0, buyers of a founding licence or a founding pack get pre-release versions. They may contain errors; the warranty section applies to them as far as the law allows.

No. 06

Your recordings

SealedVoice works offline and keeps your recordings and transcripts on your Mac; see the app privacy policy. Before you record anyone, get the consent the law and your professional rules require. Transcripts can contain errors: check them against the recording before you rely on them.

No. 07

Maintenance and support

I alone provide maintenance and support for SealedVoice; see the support page. Apple has no obligation whatsoever to provide any maintenance and support services for SealedVoice.

No. 08

Warranty

If you are a consumer, you keep your statutory rights, including those for faulty digital content. If you use SealedVoice for your trade or profession, it is provided as is, to the extent the law allows.

If a copy bought on the Mac App Store fails to conform to any applicable warranty, you may notify Apple, and Apple will refund its purchase price to you. To the maximum extent the law allows, Apple has no other warranty obligation whatsoever for SealedVoice, and any other claims, losses, liabilities, damages, costs or expenses caused by such a failure are my responsibility, not Apple’s.

No. 09

Liability

My liability is not limited for intent, gross negligence or personal injury, or where the law does not allow a limit. Otherwise, if you use SealedVoice for your trade or profession, my liability is limited to the price you paid, and I am not liable for indirect loss, such as lost profit. If you are a consumer, your statutory rights are not affected.

No. 10

Product claims

I, not Apple, am responsible for addressing any claims by you or a third party relating to SealedVoice or your possession or use of it, including product liability claims, claims that it fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

No. 11

Intellectual property

If a third party claims that SealedVoice or your possession and use of it infringes their intellectual property rights, I, not Apple, am solely responsible for the investigation, defence, settlement and discharge of that claim.

No. 12

Export and sanctions

You confirm that you are not located in a region that is subject to a US Government embargo, or that has been designated by the US Government as a “terrorist supporting” region, and that you are not on any US Government list of prohibited or restricted parties.

No. 13

Third-party terms

You must comply with applicable third-party terms when you use SealedVoice.

No. 14

Ending the licence

Your licence ends automatically if you seriously break this agreement or get a refund. Then stop using SealedVoice and delete it.

No. 15

Apple as third-party beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

No. 16
